Terms of Service

These terms are the agreement between you and Steady Spark Software LLC, a Wyoming limited liability company that runs Flashy (“Flashy”, “we”, “us”). By creating an account you accept them.
Who this agreement is with
This agreement is between you and Steady Spark Software LLC. You can hold an account if you are 18 or older (or the age of majority where you live, if higher), or if you are 13 to 17 and your parent or legal guardian agrees to these terms for you. An account can belong to a parent or guardian and, where Flashy offers it, to a tutor or teacher or a student. Students under 13 use Flashy only through a parent’s account.
From the date above, Steady Spark Software LLC runs Flashy and is the party to this agreement.
If you are a parent or guardian: a student you add studies under a profile you create and control. By creating a profile for a student, you confirm you are their parent or legal guardian, you agree to these terms on that student’s behalf as well as your own, and you agree to supervise their use and be responsible for it.
If you are a tutor or teacher: you can add students 13 or older. For each student you add, you confirm that their parent or legal guardian (or the student, if they are 18 or older) has authorized you to set up their Flashy account, and you agree to supervise your account’s use and be responsible for it. You may not add a student under 13.
If you are a student 13 to 17 with your own account: you confirm your parent or legal guardian has agreed to these terms for you. Any purchase must be made by your parent or guardian, not by you.
What Flashy does
Flashy is study software for test prep, such as the SAT and PSAT. It builds a study plan and adapts it as your student practices. It is not affiliated with, endorsed by, or a product of the College Board, ACT, or any testing organisation. We may add, change or remove features over time. Some features may be available only on a paid plan or come with limits on use. Flashy is intended for use in the United States.
Spark, the learning companion in Flashy, is an AI, not a person. It can be wrong. If something it says doesn’t look right, check it against the question’s explanation or tell us. Companion chatbots may not be suitable for some minors.
Any readiness estimate, predicted score or progress figure we show you is an estimate from your student’s practice on our platform, not an actual or official test score. We do not guarantee any score, score improvement, admission outcome or academic result.
Results depend on something we do not control: how much and how consistently your student actually does the sessions.
Your responsibilities
Keep your password to yourself, and keep your student’s password with them.
Tell us promptly if you think someone else has got into your account — email [email protected].
Do not try to break, scrape or overload the service, get around its limits, or use it to do something illegal or harmful, including trying to make Spark produce harmful content.
Keep the email address on your account current. We send notices about your account, payments and these terms to it and, unless the law requires another method, a notice sent there counts as given.
Privacy
Covered by the Privacy Policy, including a direct notice for parents about students under 13. A parent consents per student and can withdraw it at any time.
Content
The questions, explanations, handouts, study plans and software in Flashy are ours or licensed to us. These rules also cover what Spark writes.
You may use them for studying with Flashy while you have an account. You may print or save handouts, take notes, screenshot a question for your own study, and show or quote a question to a teacher, tutor, parent or classmate to get help with it.
You may not, without our written permission:
- copy, download or save content in bulk, or collect it with bots, scrapers, scripts or other automated tools;
- republish, post, sell or resell content;
- use content to train, fine-tune or test an AI model, or to build a question bank, dataset or product that competes with Flashy;
- copy, decompile or reverse engineer the software, except where the law allows it;
- sell, rent or give away access to Flashy, or let someone use a login that isn’t theirs.
We may suspend or close an account that breaks these rules. They still apply to content you got while your account was open.
What a student writes or says, including their answers and their conversations with Spark, stays theirs; we don’t claim ownership. You (and, for a student you add, you on their behalf) give us permission to use it to run, support and improve Flashy, as described in the Privacy Policy.
If you send us feedback or suggestions, we may use them without owing you anything.
Paid plans and payments
Paid plans include subscriptions, add-ons and one-time purchases. What a plan includes, including any limits on use, is described when you choose it.
Who can buy. Only an adult can buy a paid plan. By buying one, you confirm you are 18 or older (or the age of majority where you live, if higher) and allowed to use the payment method you give us.
Price and payment. Before you give us payment details, we show you the price, the billing period and any taxes. By buying, you authorize us and our payment processor to charge your payment method for them and, for a subscription, for each renewal.
Automatic renewal. Unless we say otherwise when you buy, a subscription renews automatically at the end of each billing period, and we charge your payment method for each renewal until you cancel. Before you give us payment details, we show you the renewal terms, including the price, how often you will be charged and how to cancel, and ask you to agree to them. Where the law requires, we remind you before a renewal or before a trial ends.
Trials and offers. If a plan starts with a free or discounted trial, it becomes a paid subscription when the trial ends unless you cancel before then. A promotional price applies only for the period stated with it.
Cancelling a paid plan. You can cancel a subscription at any time, online as described when you buy, or by emailing us. Cancelling stops future renewals, and you keep the paid plan until the end of the period you have paid for.
Refunds. Payments are non-refundable, including for partly used periods, except where the law requires a refund, these terms provide one, or we say otherwise when you buy.
Changes to prices and plans. We may change prices and what a paid plan includes. Before a price change, or a change that materially reduces what your subscription includes, applies to your subscription, we will tell you, with the notice the law requires and how to cancel. It takes effect from a renewal after that notice, and you can cancel before then. If you switch plans, we show you what you will be charged before you confirm.
Failed payments. If a payment fails, we may try it again, and we may pause or end the paid plan until it succeeds.
Cancelling
You can stop using Flashy whenever you like and ask us to delete your account. Deleting your account cancels any subscription and ends the paid plan straight away. We may suspend or close an account that breaks these terms or puts others or the service at risk, and we may stop offering Flashy, with notice where we can. If we close your account for another reason, or stop offering Flashy, during a period you have paid for, we will refund the unused part.
Disclaimers and limits on our liability
Please read this part.
Flashy is provided as-is. We do not warrant that it will be uninterrupted or error-free, or that any result obtained from it will be accurate.
We are not liable for indirect, incidental, special or consequential losses. Our total liability to you and everyone using your account, for all claims, will not exceed the greater of (a) what you paid us in the twelve months before the claim, or (b) one hundred US dollars ($100).
These limits do not apply to anything we are not permitted to limit by law — including our own fraud, gross negligence or willful misconduct, or death or personal injury caused by our negligence. Some places do not allow some of these limits, so parts of this section may not apply to you.
These terms are governed by the laws of the State of Wyoming. That does not take away any protection the law where you live gives you. If something goes wrong, email us first and give us a fair chance to put it right. After that, either of us may go to the state or federal courts located in Wyoming, or to small-claims court where you live.
Transfers
We may transfer this agreement as part of a merger, acquisition, sale of Flashy or reorganization, and will notify you where the law requires. The Privacy Policy explains what happens to your information if that happens. You may not transfer your account.
General
These terms, together with the Privacy Policy and any terms shown when you buy a paid plan, are the whole agreement between you and us about Flashy. If any part of them cannot be enforced, the rest still applies. If we do not enforce a part of them, we have not given up the right to enforce it later. The parts that by their nature should outlast your account, such as payments owed, the limits on our liability and the governing law, continue after it ends.
Changes to these terms
If we change these terms in a way that increases what you are responsible for, or reduces what we are responsible for, we will email the address on your account before the change takes effect, and update the date above. Other changes — corrections, clarifications, descriptions of new features — take effect when posted.
Changes apply only from when they take effect. If you keep using Flashy after a change takes effect, you accept it, but that does not replace any consent the law requires. If you do not agree to a change, stop using Flashy and close your account. Changes to a paid plan follow “Changes to prices and plans” above.
